This is an English translation provided for convenience. Jampatha Yoga is a French business and these terms are governed by French law: the French version is the binding one, and prevails in the event of any discrepancy between the two.

These terms of use (the "Terms") govern access to and use of the website www.jampathayoga.fr (the "Site") and of the student area it hosts. They apply to anyone who browses the Site or holds an account on it (the "User").

Browsing the Site constitutes acceptance of these Terms. Creating an account requires express acceptance, by ticking a box during registration.

These Terms do not govern sales. The purchase of classes and class cards is governed by the terms of sale, which cover prices, payment, cancelling a booking and the right of withdrawal. In the event of any contradiction between the two texts on a point relating to sales, the terms of sale prevail.

Article 1 — Publisher and hosting

The Site is published by Nutcharin Upacha, a sole trader (entrepreneuse individuelle under French law) operating under the trade name Jampatha Yoga, SIRET 814 187 274 00034, who is also the publication director.

The publisher's full identity, that of the technical maintainer and that of the host are set out in the legal notice, which forms an integral part of these Terms.

Article 2 — Services offered

The Site gives access, without registration, to information about the teacher, the disciplines taught, the class locations, the schedule and the prices, as well as to a contact form.

It gives access, after an account is created, to a student area allowing you to book and cancel a class, buy a class card or a single class, view your credits, your booking history and your accounting documents, and manage your personal details.

Browsing the Site is free of charge. Internet access costs and the necessary equipment remain the User's responsibility. Classes themselves are chargeable at the prices shown on the Site.

Article 3 — Creating and managing an account

Accounts may only be created by people aged 16 or over. A minor over 16 must have their legal guardian's authorisation, and that guardian remains responsible for their participation in classes.

The User undertakes to provide accurate information and to keep it up to date from their personal area. A valid email address is essential: it is used to confirm bookings, send class reminders and deliver accounting documents.

The account is strictly personal. The User is responsible for keeping their password confidential and for actions taken from their account. In the event of unauthorised use, they must inform the publisher without delay and change their password.

The "Remember me" option keeps the session open on the device used. It is not advisable on a shared computer. Logging out from the student area ends it.

Article 4 — Deleting an account

The User may delete their account at any time from the "Mon compte" (My account) section, without having to give a reason. Deletion is permanent and results in the loss of any unused credits, which are not refunded on that basis.

Some data is nevertheless retained after an account is deleted, where the law requires it: accounting documents are archived for ten years pursuant to Article L.123-22 of the French Commercial Code. Details are set out in the privacy policy.

The publisher may suspend or delete an account, after a warning that has gone unheeded except in cases of urgency or serious breach, where these Terms are not complied with, where behaviour harms the security of the Site or other students, or where bookings are manifestly abusive.

Article 5 — User obligations

The User undertakes to use the Site fairly. In particular, they must not attempt to access areas or accounts not intended for them, disrupt the operation of the Site or test its security without written authorisation, extract its content on a large scale by automated means, impersonate a third party, or create multiple accounts to circumvent a limitation.

Every booking takes a place in a class with limited capacity. A User who cannot attend is asked to cancel within the period set out in the terms of sale, so that the place can benefit another student.

Article 6 — Personal data

The Site collects and processes personal data, in particular when an account is created, when a class is booked, when a purchase is made or when the contact form is sent.

The purposes pursued, the legal bases, the recipients, the retention periods and how to exercise the rights of access, rectification, erasure, restriction, objection and portability are set out in the privacy policy.

Any request concerning personal data may be sent to [email protected]. The User also has the right to lodge a complaint with the CNIL, the French data protection authority.

Article 7 — Cookies and trackers

No audience measurement tracker is placed without the User's prior consent. A banner allows you to accept or refuse, with equal ease either way. No answer counts as a refusal, and refusing in no way restricts access to the Site or to the student area.

The only cookies placed without consent are those strictly necessary for the Site to work: keeping the session open, securing forms, and remembering the choice made about cookies.

That choice can be changed at any time using the "Gérer les cookies" (Manage cookies) link at the bottom of every page. The list of cookies, how long they are kept and what they are for are set out in the cookie policy.

Article 8 — Intellectual property

The structure of the Site, together with the text, images, photographs, videos, logos and trade marks it contains, are protected by intellectual property law and remain the exclusive property of the publisher or of their respective authors.

Any reproduction, representation, adaptation or exploitation, in whole or in part, without prior written authorisation is prohibited and constitutes infringement punishable under Articles L.335-2 et seq. of the French Intellectual Property Code.

Viewing the Site and printing pages for strictly private use remain free, subject to respecting the integrity of the content and citing its source, in accordance with Article L.122-5 of the same code.

Article 9 — Availability and liability

The publisher endeavours to keep the Site accessible 24 hours a day, 7 days a week, without being bound by an obligation to achieve that result. Access may be interrupted for maintenance, updates, or because of a fault, a network incident or force majeure. Such interruptions give rise to no compensation.

Information published on the Site is provided for guidance and updated regularly. The class schedule may change; if a class is cancelled by the publisher, the corresponding credits are returned under the conditions set out in the terms of sale.

The publisher cannot be held liable for damage resulting from use of the Site that does not comply with these Terms, nor for the loss of a password attributable to the User.

Practising yoga engages each participant's own responsibility as regards their state of health, under the conditions set out in the terms of sale.

Article 10 — Third-party links and content

The Site contains links to third-party sites, as well as a video hosted by YouTube. That video is only loaded after the User clicks: no data is sent to YouTube until playback has been started.

The publisher exercises no control over these sites and cannot be held liable for their content, their availability or their personal data practices, which are governed by their own terms.

Article 11 — Changes to these Terms

The publisher may amend these Terms at any time, in particular to take account of changes to the Site or to regulations. The applicable version is the one online at the time of connection, identified by the date it came into force shown at the top of this document.

Where a substantial change affects account holders, they are informed by email.

Article 12 — Governing law and disputes

These Terms are governed by French law.

In the event of difficulty, the User is invited to contact the publisher at [email protected] in order to seek an amicable solution. A consumer who does not obtain satisfaction may use a consumer mediator free of charge, under the conditions set out in Article 14 of the terms of sale.

Failing agreement, the dispute falls within the jurisdiction of the competent French courts.
