These terms of sale (the "Terms") govern the sale of yoga classes and class cards by Jampatha Yoga, whether purchased online at jampathayoga.fr or in person. They apply to consumers within the meaning of the French Consumer Code.
Every order implies full and complete acceptance of these Terms, in the version in force on the date of the order. Access to the site and to the student area is otherwise governed by the terms of use.
The services offered, their prices and the applicable cancellation period differ by teaching location. The prices below are in euros, all taxes included; as VAT is not applicable, they are net of tax.
Free cancellation period: 24 hours before the class
starts.
Bookings close: 2 hours before the
class starts.
The schedule, the number of places per class and the disciplines taught can be consulted on the site. Prices may be changed at any time; the applicable price is the one displayed at the time of the order.
Buying online requires creating a personal account on jampathayoga.fr. The order is final once payment is validated; a confirmation email summarising the service purchased is then sent.
Buying a card credits the account with the corresponding number of classes. Booking a class debits one credit at the time of booking, and not at the time the class takes place. A booking is only possible if the account holds a valid credit and if the class is not full, places being limited.
A confirmation email is sent for every booking, and a reminder before the class.
Bookings for a class close a certain time before it starts, as stated in Article 3 for the location concerned. This period allows the teacher to know whether the class has participants before travelling; a class with no one registered may be cancelled, in which case any credits already debited are returned.
Online payment is made by bank card via Stripe, a payment provider that secures the transaction. No bank details are received or stored by Jampatha Yoga.
Payment in person is also possible, on terms agreed with the teacher. In that case, credits are added to the account immediately, before payment is collected: the pass can be used as soon as it is taken out, and the student undertakes to pay the amount directly to the teacher. Payment remains due regardless of how the credits are used.
For online payment methods with deferred confirmation, credits are only added once the payment has actually been confirmed by the financial institution.
A document is issued for every purchase and remains viewable and downloadable from the student area, under "Mes achats" (My purchases). A receipt is issued by default; an invoice can be requested from that same section.
These documents are kept for ten years, in accordance with Article L.123-22 of the French Commercial Code, including after an account is deleted.
Classes booked for a specific date. Pursuant to Article L.221-28, 12° of the French Consumer Code, the right of withdrawal does not apply to leisure services supplied on a specific date or during a specific period. Buying a class attached to a specific time slot therefore does not give rise to a right of withdrawal.
Cards and credits. Buying a card, which is not attached to a specific date at the time of the order, gives rise to a right of withdrawal of fourteen days from the conclusion of the contract. This right is exercised without having to give a reason, by a simple email to [email protected]. The refund is made within fourteen days of receiving the request, using the same payment method as the one used for the purchase.
By booking a class before that period expires, the buyer expressly requests that performance of the service begin before the end of the withdrawal period. Pursuant to Article L.221-25 of the same code, they then remain liable for the amount corresponding to the credits already used; the balance of unused credits is refunded to them.
A booking can be cancelled free of charge from the student area up to the period stated in Article 3 for the location concerned. The credit is then returned and becomes available again for another booking.
After that time, since the place can no longer be offered to another student, the credit is considered used and is not returned. The same applies in the event of a no-show without cancellation.
If a class is cancelled at the initiative of Jampatha Yoga, for whatever reason, the students registered are informed and the corresponding credit is returned in full. No other compensation is due.
Credits are valid for the period stated in Article 3 for the offer concerned. That period runs from the date of the first class booked, and not from the date of purchase: a card bought before a closure period does not lose its validity while no classes are taking place.
It is the date of the class that counts, not the date the booking is made: booking in advance uses up no validity.
An unused card must be started within 12 months of its purchase, meaning that a first class must take place before that deadline. After that, the card can no longer be used.
This period limits when the card can be started, not its total duration: a card whose first class takes place on the last day of that period then remains valid for the full period provided for in Article 3.
In any event, a card cannot be used beyond its activation period plus its validity period, that is at most 12 months after purchase followed by that duration. No succession of bookings and cancellations can push back this limit.
The expiry date is shown at all times in the student area from the first booking onwards. Credits not used by the expiry date are lost and give rise to neither refund nor extension. In the event of a lasting and justified impediment, a request may be sent to the teacher, who will consider it case by case.
Each participant practises under their own responsibility and declares that they are fit to attend classes. It is recommended to seek a doctor's opinion before starting any physical activity, particularly in the case of a medical history, pregnancy or recent injury.
Participants undertake to inform the teacher, before the class, of any health problem, injury or contraindication liable to affect their practice, and to adapt or stop any exercise that is uncomfortable for them.
Jampatha Yoga cannot be held liable for an accident resulting from an inaccurate declaration or an unreported contraindication, nor for the theft or damage of personal belongings at the teaching locations.
The data collected when an order is placed is necessary for processing it, managing bookings and complying with accounting obligations. The purposes, recipients, retention periods and how to exercise your rights are set out in the privacy policy.
The content of the jampathayoga.fr site — text, photographs, videos, logo — is protected by intellectual property law. Any reproduction without prior written authorisation is prohibited. Buying a class confers no right over this content, nor over the teaching provided.
Any complaint may be sent to [email protected]. A reply is given as soon as possible, and an amicable solution is sought as a priority.
Pursuant to Articles L.616-1 and R.616-1 of the French Consumer Code, consumers have the right to use a consumer mediator free of charge in order to reach an amicable settlement of a dispute, after having sent a written complaint that received no satisfactory reply. The mediator's details can be obtained on simple request at [email protected].
Jampatha Yoga may amend these Terms at any time. The conditions applicable to an order are those in force on the date of that order, as accepted at the time of payment.
These Terms are governed by French law. Failing an amicable settlement, and after any recourse to mediation, the dispute falls within the jurisdiction of the competent French courts.
